Special act about helping Ukrainian citizens – work in Poland

In the evening of the day 12 of march 2022 year President of Poland, Andrzej Duda signed special act concering help about Ukrainian citizens, i.a. legal work in Poland. The new regulations will enter into force on the date of their publication in the Journal of Laws and will apply retroactively, i.e. from February 24, 2022.

The special act applies to the following:

  1. Ukrainian citizens who have crossed the Polish-Ukrainian border and have a border guard stamp;
  2. Ukrainian citizens who have a Pole’s Card, who came to Poland with their the most closest family;
  3. Citizens who do not have Ukrainian citizenship, but are married to a citizen of Ukraine.

The most important points included in the special act

  • Ukrainian citizens who crossed the Polish-Ukrainian border from February 24, 2022 can legally reside in the territory of the Republic of Poland for 18 months, counted from February 24, 2022 (including children born in Poland by a Ukrainian citizen).
  • If a citizen of Ukraine leaves Poland for a period exceeding 1 month, then she/he will lose the privileges guaranteed by the special act.
  • A citizen of Ukraine who has not crossed the Polish-Ukrainian border or does not have a stamp of the Polish Border Guard, must register with any executive body of the Polish commune within 60 days from the moment of arrival in Poland. On the basis of the submitted application and the declaration, it is possible to obtain a PESEL number. In addition, citizens of Ukraine who have crossed border different than the Polish one, e.g. Slovakia-Poland, are deprived of most of the privileges included in the Polish special act. They should become familiar with solutions proposed by a given state, in this case e.g. Slovakia.
  • The special act facilitates legalization of work in Poland – an employer hiring a citizen of Ukraine is obliged to inform a competent employment office via the portal – prac.gov.pl within 14 days from the moment of employment, about entrusting the Ukrainian with work by completing a form on the website.
  • In addition, Ukrainian citizens under the special act will be able to take advantage of a one-time financial aid in the amount of PLN 300 and will be able to use free medical care.
  • Under the special act, the validity of residence permits and visas for all Ukrainian citizens is automatically extended until December 31, 2022.
